Welcome to Rad Art. These Terms of Service (“Terms”) govern your use of our website radart.dk and the purchase of products from our online store. By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

Rad Art is an online art print store offering original artwork, prints, and custom commissions.


2. Scope of These Terms

These Terms apply to:

  • Physical art prints and original artworks

  • Custom commissioned paintings

  • Any future digital products (e.g. digital downloads)

  • Use of the Rad Art website and services

Separate terms may apply to specific products or services, which will be clearly stated at the time of purchase.


3. Products and Fulfillment

3.1 Product Types

Rad Art offers:

  • Original cosmic and abstract art prints

  • Limited or open-edition physical prints

  • Custom commissioned paintings

  • Potential future digital products

3.2 Fulfillment and Third-Party Suppliers

Most products are shipped from Denmark.
Some products are fulfilled by third-party suppliers located in Canada.

Important:
Even when third-party suppliers are used, Rad Art remains fully responsible for:

  • Product quality

  • Delivery

  • Customer service

  • Handling complaints, returns, and refunds

Your contract is always with Rad Art, not the third-party supplier.

3.3 Split Shipments

Orders containing multiple items may be shipped in separate packages and may arrive at different times. This does not affect your statutory rights.


4. Prices, VAT, and Customs

4.1 Prices

All prices are shown in the currency displayed on the website and include applicable Danish/EU VAT unless otherwise stated.

4.2 Customs, Duties, and Import VAT

For items shipped from Canada to the EU or other non-EU destinations:

  • Customs duties, import VAT, and handling fees may apply

  • These charges are not included in the product price unless explicitly stated

  • The customer is responsible for paying any such charges

Rad Art is not responsible for delays caused by customs processing.


5. Payment Terms

We accept the payment methods displayed at checkout, which may include:

  • Credit/debit cards

  • Digital payment providers

  • Other secure payment solutions

Payment is charged at the time of order confirmation unless otherwise stated.

Rad Art reserves the right to refuse or cancel orders due to:

  • Payment authorization failure

  • Suspected fraud

  • Pricing or listing errors


6. Shipping and Delivery

6.1 Delivery Times

Estimated delivery times are provided at checkout and are indicative only. Delivery times may vary depending on:

  • Destination

  • Production time

  • Customs clearance

  • External factors beyond our control

6.2 Force Majeure

Rad Art is not liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Pandemics

  • War or strikes

  • Supply chain disruptions

  • Customs delays


7. Right of Withdrawal and Returns

7.1 EU 14-Day Cooling-Off Period

If you are an EU consumer, you have the legal right to withdraw from your purchase within 14 days of receiving the goods, without providing a reason.

You must notify us in writing (email is sufficient) before the withdrawal period expires.

7.2 Extended 30-Day Return Policy

In addition to your statutory rights, Rad Art offers a 30-day return policy for eligible physical products, provided they are:

  • Unused

  • In original condition

  • Returned in original packaging

7.3 Return Exceptions

The following are non-refundable:

  • Custom commissioned artworks once work has begun

  • Digital products once downloaded or accessed

  • Items damaged due to improper handling after delivery

7.4 Return Costs

Unless the product is defective or incorrect, the customer is responsible for return shipping costs.


8. Custom Commissions

Custom commissioned artworks are created specifically for you.

By placing a custom order, you agree that:

  • Work begins after order confirmation

  • The order becomes non-refundable once work has started

  • Minor revisions may be offered at Rad Art’s discretion

  • Final artistic interpretation remains with the artist


9. Digital Products (Future Use)

If digital products are offered:

  • They are licensed for personal use only

  • Redistribution, resale, or modification is prohibited

  • Access may be revoked in case of misuse

Digital purchases are final once delivery or download begins, unless otherwise required by law.


10. Intellectual Property

All artwork, images, text, and content on radart.dk are the exclusive intellectual property of Rad Art or its licensors.

You may not:

  • Copy, reproduce, or distribute artwork

  • Use artwork for commercial purposes

  • Create derivative works without written permission

Purchasing a physical or digital product does not transfer copyright.


11. Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Attempt to disrupt site functionality

  • Copy or scrape content without permission

Rad Art may suspend or terminate access for misuse.


12. Limitation of Liability

To the maximum extent permitted by law:

  • Rad Art is not liable for indirect or consequential damages

  • Our liability is limited to the amount paid for the relevant product

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence

  • Fraud

  • Rights that cannot be excluded under Danish or EU law


13. Privacy and Data Protection (GDPR)

Rad Art processes personal data in accordance with the EU General Data Protection Regulation (GDPR).

We collect and process data only as necessary to:

  • Fulfill orders

  • Provide customer support

  • Comply with legal obligations

14. Modifications to These Terms

Rad Art reserves the right to update or modify these Terms at any time.
Changes will be published on the website and apply from the date of publication.

Continued use of the website constitutes acceptance of the updated Terms.


15. Governing Law and Dispute Resolution

These Terms are governed by Danish law.

Any disputes shall be subject to the jurisdiction of the Danish courts, unless mandatory consumer protection laws provide otherwise.

EU consumers may also use the EU Online Dispute Resolution (ODR) platform.
